Atlantix Media Networks Terms of Service

This Terms of Service (or "TOS"), which we may update from time to time without notice to you, is a legal agreement between you and Atlantix Media Networks (or "us") regulating your partecipation on the Atlantix Media Networks website.

Description of Service.

Atlantix Media Networks is a worldwide media company specializing in the creation of content rich remarkable web concepts. By focusing on developing extraordinary ideas into exciting interactive experiences, Atlantix Media Networks prides itself on being able to deliver exactly what users need in a constantly evolving interactive age.

You understand and agree that the Service may include advertisements in several different forms, and that these advertisements are necessary for Atlantix Media Networks to provide the Service. You agree that the Service may include communications from Atlantix Media Networks through various medium, and these are part of Atlantix Media Networks membership. Any new features that are added to or enhance the current Service, shall be subject to the TOS. The Service is provided "AS-IS". Consequently, Atlantix Media Networks assumes no responsibility for the timeliness of delivery or failure to store any user communications or custom settings. You are responsible for any fees arising from obtaining access to the Service, including any third-party fees (ISP charges, etc).

Registration.

You understand that in order to gain access to additional priviligies, you have the option to register with us. Registration is not required in order to visit our website. However, registration entitles you to several benefits. When you register with Atlantix Media Networks, we require you to provide us with personal information such as your email address, your country, city, and state, your occupation, gender, and interest, your website if any. This information is stored by Atlantix Media Networks. You agree to provide accurate, up-to-date information about yourself when you register with us. You also agree to promptly update your personal membership data to keep it current and complete. Atlantix Media Networks reserves the right to suspend or terminate your account at any time without prior notice.

Content Submission.

Atlantix Media Networks does not claim ownership of content you contribute or submit to the Service. You warrant that you are the author and owner of the intellectual property rights of the content you submit. However, you grant Atlantix Media Networks a worldwide, perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology, and that all "moral rights" that you may have in that content have been voluntarily waived by you. You agree that you shall not submit any information:
1. known to be false or inaccurate;
2. defamatory, libelous, hateful, racially or religiously offensive in nature;
3. that infringes any third party's proprietary rights such as copyrights, patents, trademarks, etc;
4. that includes any third party's personal data;
5. for which you received any kind of compensation.

Indemnity.

You agree to indemnify and hold Atlantix Media Networks and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or otherwise make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.

Modifications to Service.

Atlantix Media Networks reserves the right to modify or discontinue the Service at any time with or without prior notice. You agree that Atlantix Media Networks shall not be liable to you or to any third party for any modification, or discontinuance of the Service.

Minors' use of our site.

The use of Atlantix Media Networks is not intended by anyone under the age of 18. By accessing and using Atlantix Media Networks, you represent and warrant that you are 18 years of age or older. We will cancel any membership belonging to a minor, should we become aware that you are under 18 years of age.

Termination.

Atlantix Media Networks reserves the right to suspend or terminate your account at any time without prior notice. You can cancel your account at any time by emailing info@atlantixmedia.com. Excessively inactive accounts will be deemed to be abandoned and closed accordingly.

Limitation of Liability.

You agree that Atlantix Media Networks and its subsidiaries, affiliates, officers, employers, agents, partners, and licensors shall not be liable to you for any direct, indirect, incidental, special, consequental or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from 1) the user or the inability to use the Service; 2) the cost of procurement of substitute goods and services resulting from any goods, data, information or service purchased or obtained or messages received or transactions entered into through or from the Service; 3) unauthorized access to or alteration of your transmission or data; 4) statements or conduct of any third party on the service; or 5) any other matter relating to the Service.
